Terms of Service.

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you and PotentialSpouse ("we", "us", "our"). They govern your access to and use of the PotentialSpouse website, application, and related services (the "Service"). By creating an account, signing in, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy , which is incorporated by reference.

If you do not agree, do not use the Service.

2. Eligibility

  • You must be at least 18 years old. You confirm this when you create your profile by providing your date of birth; profile creation rejects dates that imply you are under 18.
  • You must have the legal capacity to enter into a binding agreement in your jurisdiction.
  • You must not be barred from using the Service by a previous enforcement action by us, by sanctions law, or by a court order in any jurisdiction where you live or use the Service.
  • The Service is intended for personal, non-commercial use by adults seeking long-term relationships. It is not a directory, a social network, a marketing tool, or a service for finding casual encounters.

3. Your account

  • Authentication is through Google OAuth. We do not receive, store, or display your email address, real name, or profile photo. We hold a one-way HMAC-SHA256 hash of your Google account identifier; the original identifier is discarded immediately after the hash is computed. See the Privacy Policy for technical detail.
  • On account creation we generate a three-word codename (e.g. coral-bridge-falcon) drawn from the EFF Large Wordlist. This codename is the only identity other users see. You may edit it once within the first 30 days of account creation; after that it is permanent.
  • You are responsible for any activity from your account. If your Google account is compromised, sign out of every device via Settings → Sessions and notify us immediately at fedhaly@gmail.com.
  • Each person may hold at most one active account. Creating a duplicate account to circumvent a block, ban, or other enforcement is itself grounds for termination of all accounts you control.

4. Acceptable use

Any of the following is grounds for immediate account suspension or termination, with or without notice:

  • Harassment. Threats, intimidation, sexual content directed at users without consent, persistent unwanted contact after a block or non-response, or any conduct that creates a hostile environment.
  • Impersonation and fraud. Pretending to be someone you are not, falsifying profile attributes (gender, age, faith, marital status, location, employment, etc.) in a way intended to deceive matches, or using the Service to carry out a romance scam, identity theft, or any form of financial fraud.
  • Automated access. Scraping, crawling, mass-downloading, reverse-engineering, or otherwise extracting data from the Service via anything other than the user-facing interface.
  • Commercial use. Selling, leasing, or renting tags, codenames, profile slots, or any part of the Service; using the Service to advertise products or services; using the Service to recruit candidates, customers, or members for any other organisation or platform.
  • Off-platform contact harvesting. Soliciting phone numbers, email addresses, social media handles, or other real-world identifiers from other users inside the PotentialSpouse chat. Exchanging such identifiers consensually between two users who have already accepted a connection is permitted; soliciting them at scale is not.
  • Circumventing technical measures. Working around block lists, rate limits, moderation, the matching engine's reciprocity rules, or the code-level age check.
  • Illegal content or conduct. Anything unlawful in your jurisdiction or in the jurisdictions where our Service is operated.

5. Content you submit

You retain ownership of the questions, answers, and chat messages you write ("Content"). By using the Service you grant us a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, transmit, and display your Content only as necessary to operate the Service for you and the specific other users it is addressed to. This licence terminates when you delete the Content or your account, except for Content that has already been delivered to another user (which we cannot retroactively redact from their inbox) and anonymised aggregate data that contains no personal information.

We do not sell your Content, share it with advertisers, or use it to train external machine-learning systems. The narrow exceptions are disclosed in the Privacy Policy.

You represent and warrant that you own or have the right to submit the Content you submit, and that doing so does not violate the rights of any third party.

6. Intellectual property

The Service, including its design, code, text, graphics, and the PotentialSpouse name and logo, is owned by us and protected by copyright, trademark, and other intellectual-property laws. Nothing in these Terms transfers any ownership right in the Service to you.

If you believe Content on the Service infringes your intellectual property, send a notice to fedhaly@gmail.com with: a description of the work, the location of the alleged infringement on our Service, your contact information, a statement of good-faith belief that the use is not authorised, and a statement that the information in the notice is accurate. We will respond within a reasonable time.

7. Account termination

  • By you. You may delete your account at any time via Settings → Danger zone. This anonymises your codename, removes your profile from the database, cancels pending connections, and permanently disables sign-in. The retention details for your data after deletion are described in the Privacy Policy.
  • By us. We may suspend or terminate your account for breach of these Terms, for behaviour that endangers other users, in response to a valid legal request, or as required by applicable law. Where reasonable and not prohibited by law, we will give you notice and an opportunity to respond.
  • What survives termination. Sections covering Intellectual Property, Disclaimers, Liability, Indemnification, and Dispute Resolution survive any termination of these Terms.

8. No relationship guarantee

The Service is a platform for structured introductions. We do not vet users beyond moderating reported behaviour, we do not verify identity beyond the Google OAuth handshake, and we cannot certify any user's intent, honesty, marital status, finances, health, or character. Decisions to communicate, meet, share personal information, or commit are entirely yours, and you assume all associated risks.

We make no promise that the Service will lead to a relationship, marriage, or any specific outcome.

9. Service availability and changes

The Service is provided on an "as is" and "as available" basis. We make reasonable efforts to keep the Service online and functioning, but we do not guarantee uninterrupted availability, error-free operation, or that the Service will meet your expectations.

We may modify, suspend, or discontinue parts of the Service at any time, with or without notice. We will not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.

10. Disclaimer of warranties

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, security, and uninterrupted availability. Some jurisdictions do not permit the exclusion of certain warranties; in those jurisdictions, our warranties are limited to the minimum required by applicable law.

11. Limitation of liability

To the maximum extent permitted by law, we and our directors, employees, contractors, agents, suppliers, and licensors will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, loss of business opportunity, emotional distress, or harm to relationships, arising from or related to your use of the Service.

Our aggregate liability for any direct damages arising from or related to your use of the Service is limited to the greater of (a) the fees you have paid to us in the twelve months preceding the claim, or (b) USD 100. Some jurisdictions do not allow this limitation; in those jurisdictions our liability is limited to the minimum required by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless PotentialSpouse and its directors, employees, contractors, agents, suppliers, and licensors from any claim, demand, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of another person's rights, or the Content you submit.

13. Force majeure

We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, war, civil unrest, government action, labour disputes, infrastructure failure, internet outages, denial-of-service attacks, or pandemic. Our obligations are suspended for the duration of the event.

14. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved in the courts of Nairobi, Kenya, except where your local consumer-protection law gives you the right to bring proceedings in your country of residence.

Before initiating formal proceedings, you agree to make a good-faith effort to resolve the dispute by writing to us at fedhaly@gmail.com. We will respond within thirty (30) days.

15. Changes to these Terms

Material changes — additions to data collection, third-party processors, content rules, dispute resolution, or grounds for termination — will trigger a new version of these Terms. You will be prompted to review and accept the new version on your next sign-in; until you do, you will not be able to use the authenticated parts of the Service. Cosmetic changes (typos, formatting, broken-link fixes, clarifications that do not change your obligations) do not trigger a new version.

If you do not accept a new version of these Terms, you may delete your account at any time via Settings → Danger zone.

16. Severability and entire agreement

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect. These Terms, together with the Privacy Policy , constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.

17. No waiver and no assignment

Our failure to enforce any provision of these Terms is not a waiver of that provision or any other. You may not assign or transfer your rights under these Terms without our written consent. We may assign our rights and obligations under these Terms at any time without notice.

18. Notices

Notices to us must be sent to fedhaly@gmail.com. Notices from us will be displayed within the Service or, where the law requires direct notice, posted on our website. Because we do not collect your email address, we cannot reach you by email; the burden is on you to check the Service for announcements.
